DMCA Policy

RDownload Media Limited (“RDownload”) respects the intellectual property rights of others and expects its users to do the same.  RDownload.org qualifies as a “Service Provider” within the meaning of 17 USC § 512(k)(1)of the Digital Millennium Copyright Act (“DMCA”) and is therefore entitled to certain “safe harbour” protections against copyright infringement allegations as set out therein.  This RDownload DMCA Policy sets out our adherence with the DMCA, a copy of which can be found on the U.S. Copyright Office’s website at http://www.copyright.gov/legislation/dmca.pdf.  This policy shall be read in accordance with RDownload’s Privacy Policy, Terms and Conditions, and Authorized Removal Agent Policy.
RDownload will respond claims alleging copyright infringement using RDownload’s services efficiently and promptly when such claims are reported to RDownload’s Designated Copyright Agent identified below or submitted via a DMCA Notification Ticket containing the information as set out below.  Content removal pursuant to a Notice of Alleged Infringement may be challenged through a Counter-Notification.
Once RDownload has received the Notice of Alleged Infringement, RDownload will take whatever action in its sole discretion it deems appropriate including, but not limited to, removal of the allegedly infringing content.

Notice of Alleged Infringement

Alleged copyright infringements occurring on or through RDownload.org shall be reported  by the copyright owner, someone authorized to act on behalf of one, or authorized to act under any exclusive right under copyright by filling out a DMCA Notice of Alleged Infringement and sending it to RDownload’s Designated Copyright Agent or submitted via a DMCA Notification Ticket. 


  1. Identify Copyrighted Work – Identify the copyrighted work that you claim has been infringed.  If multiple copyrighted works are covered by this Notice you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify Copyright Infringement – Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on RDownload.org or the exact location where such material may be found.
  3. Contact Information – Provide your name, company affiliation (if applicable), mailing address, telephone number, and email address.
  4. Required Language – Include both of the following statements in the body of the Notice:

“I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”
“I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of, the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”


  1. Signature – Provide your full legal name and your electronic or physical signature.

Please do not send other inquires or information to our Designated Agent. Absent prior express permission, our Designated Agent is not authorized to accept or waive service of formal legal process, and any agency relationship beyond that required to accept valid DMCA Notices is expressly disclaimed.
If the notice does not comply with §512 of the DMCA, but does comply with three requirements for identifying sites that are infringing according to §512 of the DMCA, RDownload shall attempt to contact or take other reasonable steps to contact the complaining party to help that party comply with the notice requirements.
Abusing the DMCA procedures set forth above, or misrepresenting facts in a DMCA Notice or Counter-notification, can result in legal liability for damages, court costs and attorney fees under applicable laws.  These Notice and Takedown Procedures only apply to claims of copyright infringement by copyright holders and their agents – not to any other kind of abuse, infringement or legal claim.  We will investigate and take action against anyone abusing the DMCA notification or counter-notification procedure.  Please ensure that you meet all of the legal qualifications before submitting a DMCA Notice to our Designated Agent or through RDownload’s DMCA Notification Tickets.

Take-Down Procedure

RDownload has implemented a “notification and takedown” procedure triggered upon receipt of Notification of Alleged Infringement as set out above.  RDownload reserves the right to disable access and/or remove any content or activity accessible on or from RDownload.org relating to any cited content claimed to be infringing through the following Take-Down Procedure.
Where a Notice of Alleged Infringement is received by RDownload’s Designated Agent or through the DMCA Notification Ticket, RDownload will expeditiously remove and/or disable access to the infringing material and shall notify the affected user. 
Accounts of repeat offenders may be terminated at the sole discretion of RDownload when appropriate.

Counter-Notification Procedure

A RDownload user who has had content removed or disabled pursuant to a Notice of Alleged Infringement may submit a Counter-Notification to the RDownload DMCA Agent or through a DMCA Counter-Notification Ticket containing the following information:


  1. Identify Removed Content – Identify the content that has been removed or disabled pursuant to a Notice of Alleged Infringement.
  2. Location of Removed Content – Identify the location of the content or material prior to the removal or disabling, preferably the URL of the link shown on RDownload.org or the exact location where such material may be found.
  3. Contact Information – Provide your name, company affiliation (if applicable), mailing address, telephone number, and email address.
  4. Required Statement – Include the following or similar statement reflecting your belief that the removal or disabling of the material was done so erroneously such as the following:

 “I hereby swear, under penalty of perjury, that I have a good faith belief that the referenced material was removed or disabled by the service provider as a result of mistake or misidentification of the material to be removed or disabled.”


  1. Choice of Venue – a statement that you consent to the jurisdiction of the United Kingdom.

After RDownload has received a Counter-Notification, it will replace the material at issue within 10-14 days after receipt of the Counter-Notification if the file is still accessible and can be retrieved or restored unless the Designated Agent receives notice that a court action has been filed by the complaining party seeking an injunction against the infringing activity
